Announcement Concerning Another Term

Dear Neighbors,

I write to inform you that I will not be seeking re-election this November to the position of Advisory Neighborhood Commissioner.

The decision to announce a run for office comes with the implicit promise to the voters that the candidate will strive to complete the full term to which he or she is elected. I could not in good faith make this promise because I am looking to transition to a new job within the year, either as a prosecutor or a counsel at a private firm. The new job, possibly requiring geographical relocation, would likely require a level of time and attention that would be incompatible with ANC duties.

Fortunately, there is a person who I am confident will keep the momentum going in the right direction by serving as your next ANC. That person is Ted McGinn. He understands that our area needs economic development that reflects our neighborhood’s character. He interacts well with people of all backgrounds and incomes. He is a clear communicator who is also incredibly well-informed. Ted’s track record of service to this community is impeccable. I have asked Ted to run for the office of Commissioner, and he has agreed to take on this latest challenge.

It has been an honor to serve as a Commissioner in the District of Columbia.

Staff Attorney Positions—

Civil Litigation Division, Consumer and Trade Protection Section: Trial Attorney

The Civil Litigation Division of the Office of the Attorney General for the District of Columbia is seeking a trial attorney to handle antitrust enforcement matters for the Consumer and Trade Protection Section. This attorney will work exclusively on civil enforcement of the District’s Antitrust Act and federal antitrust laws. About half of this antitrust enforcement work will be conducted through participation in multi-state groups of assistant attorneys general seeking to investigate, litigate, or resolve antitrust issues on a national scale. And about half will involve “local” issues pertaining specifically to competition in the District of Columbia or within the Washington, DC metropolitan area. Duties include: identifying areas for investigation, conducting pre-complaint discovery using civil investigative demands and informal methods, analyzing complex factual and legal issues, negotiating settlements, preparing matters for litigation, litigating cases, drafting amicus filings, coordinating efforts with the federal antitrust agencies, and educating the legal and business communities.

The successful candidate must have a law degree and be a member of the District of Columbia Bar or be eligible for waiver into the bar. If a candidate is selected and is not a member of the District of Columbia Bar, he/she must apply for membership and show proof of such prior to the commencement of employment. The successful candidate must have familiarity with antitrust law principles – acquired either through legal experience or coursework. Civil litigation experience is desirable but not required. The candidate must also have excellent research and writing skills.

The position is within the Collective Bargaining Unit. It is a 13-month term appointment, funded by the District of Columbia Antitrust Fund (DC Code § 28-4516). Civil Litigation Division, General Litigation Section: Trial Attorney (2 Positions)

The Civil Litigation Division of the Office of the Attorney General for the District of Columbia is seeking two trial attorneys for its General Litigation section. General Litigation is responsible for defending the District of Columbia in civil lawsuits in which plaintiff seeks money damages and/or individual injunctive relief. The General Litigation sections defend cases in both DC Superior Court and the US District Court for the District of Columbia. The cases primarily are in the areas of government contract, personal injury (slip and fall, automobile, police false arrest/assault, medical malpractice and inmate assaults), federal constitutional civil rights claims (First Amendment claims regarding freedom of religion, the right to demonstrate and protest in public areas, whistle blower claims) and employment discrimination.

The Attorney’s primary responsibility for this position will include defending the District of Columbia before the DC Contract Appeals Board relating to breach of contract claims filed by contractors. The successful candidate for this position should have at least 3 years of experience in government contract litigation, preferably in the area of breach of contract claims. In addition, the candidate should be knowledgeable of the DC Procurement Practices Act (PPA) and/or the Federal Acquisition Regulations (FAR). The successful candidate must also have a law degree, excellent research and writing skills, experience in conducting discovery and prior trial experience.

Department of Consumer and Regulatory Affairs: Assistant Attorney General

The Office of the Attorney General for the District of Columbia (OAG) is seeking candidates for the position of Assistant Attorney General in the Office of the General Counsel (OGC) for the Department of Consumer and Regulatory Affairs (DCRA). DCRA protects the health, safety, economic interests, and quality of life of residents, businesses, and visitors in the District of Columbia by issuing licenses and permits, conducting inspections, enforcing building, housing, and safety codes, regulating land use and development, and providing consumer education and advocacy services. DCRA takes legal action against businesses and individuals who violate District laws, and works to prevent the occurrence of illegal, deceptive, and unfair trade practices through education and public awareness programs.

In furtherance of DCRA’s mission, the Office of the General Counsel (1) provides legal advice and support to the agency’s senior management team on a broad range of matters; (2) represents DCRA in administrative hearings before the Office of Administrative Hearings and the Board of Zoning Adjustment; (3) participates in development of legislation and rules for the agency; and (4) assists in drafting memoranda of understanding with other District agencies.

The candidate must have a working knowledge of the operations of the District government, effective interpersonal skills, strong legal research and writing skills, and effective oral and written communication skills and litigation skills. Knowledge of relevant federal and District public laws including the District’s Construction, Housing and Zoning Codes, the Nuisance Abatement Reform Amendment Act of 2006, the General License Law, the Business Corporation Act and the Department of Consumer and Regulatory Affairs Civil Infractions Act of 1985 is highly desirable. Specific experience in legislative drafting and rulemaking is also desirable

Department of Mental Health: Attorney-Advisor

The Office of the Attorney General for the District of Columbia is seeking an Attorney-Advisor for the Office of the General Counsel for the Department of Mental Health (DMH). The Attorney-Advisor will report to the General Counsel, work directly with DMH managers and handle a variety of complex matters involving the various programs and services operated by DMH. The Attorney-Advisor provides legal assistance to the counsel of record for DMH in Dixon v. Williams and provides advice and services to DMH staff with respect to compliance with the requirements of the various Dixon orders and the Dixon exit criteria.

The incumbent will provide legal advice to management in all employment-related matters, including labor arbitration and negotiations, compliance with Title VII, ADEA, ADA, and other federal, state and local laws regulating employment before administrative tribunals. Particularly, the successful candidate will advise the agency on personnel actions such as adverse actions for cause that result in removal, reduction in grade, or suspension for 10 days or more; Reductions-in-force (RIF); performance ratings which result in the removal of the employee; and placement of employee on enforced leave that lasts 10 days or more.

Other duties include (1) drafting legislation and regulations that will enhance DMH’s missions and programs; (2) researching laws, legal opinions, policies, regulations, and cases bearing on legal issues involving DMH policies and programs and providing oral and/or written opinions to the three operating division of DMH (Saint Elizabeth’s Hospital, the District of Columbia Community Services Agency and the Mental Health Authority), as appropriate; (3) representing DMH at administrative hearings; and (4) providing litigation support to the Office of the Attorney General.

The successful candidate for this position must be a member of the DC Bar or eligible to waive into the Bar and must have a working knowledge of the operations of the District government, excellent interpersonal skills, and effective oral and written litigation skills. The candidate must also have a demonstrated knowledge of the federal and District public laws, including: the Ervin Act, the District of Columbia Mental Health Information Act, and the Mental Health Establishment Amendment Act of 2001.

Department of Transportation: Attorney-Advisor (2 Positions)

The Office of the Attorney General of the District of Columbia is looking for two Attorney-Advisors to work in the Office of the General Counsel for the Department of Transportation.

The Department of Transportation (DDOT) provides municipal services in three distinct program areas: transportation infrastructure, transportation policy, and public space management. Each contribute to making District streets and public spaces effective means of transporting people, goods, and information efficiently and safely, with minimal adverse impacts on residents and the environment.

The successful candidates for this position will provide legal guidance on policy, legislative, administrative and personnel matters. The attorney will represent DDOT in adjudicatory and quasi-adjudicatory proceedings including representing the Department before the Office of Administrative Hearings, which conducts administrative hearings on appeals of unemployment compensation and notices of violations of the laws, rules, or regulations set forth in DC Law 6-100, the Litter Control Administration Act of 1985, effective March 25, 1986. The successful candidate will be responsible for preparing pretrial discovery, writing motions, preparing briefs, and conducting direct and cross-examination of witnesses. The successful candidate will provide legal support to OAG on matters before the Office of Employee Appeals where agency disciplinary actions are appealed. In addition, the successful candidate will represent the agency before the DC Office on Human Rights and the Equal Employment Opportunity Commission on mediations and fact-finding sessions; and responding to complaints of discrimination.

The successful candidate will conduct legal sufficiency reviews of transportation safety grants awarded to the District by the National Highway Transportation Safety Administration (NHTSA), and provide legal advice on the allowable uses of NHTSA grants. The successful candidate will also conduct legal sufficiency reviews of MOAs and MOUs; draft legislation; conduct legal research and writing; and prepare legal advice memoranda. Experience in complex real estate transactions and acquisitions is highly desirable but not required (e.g., transactional experience with title work, deed, easement, lease, purchase and sale preparations, real estate closings, or related matters; real estate acquisition by eminent domain or quiet title).

District of Columbia Public Schools: Attorney-Advisor

This position is located in the Office of the General Counsel (OGC), DC Public Schools (DCPS) serving as an Attorney-Advisor in providing legal guidance and rendering opinions for DCPS in the area of special education by facilitating legal compliance with the requirements of the Individuals with Disabilities Education Improvement Act of 2004 (IDEIA). This office helps ensure that DCPS meets the needs of their students in a fair and consistent nature.

The candidate must have knowledge and ability to provide a full range of legal advice and litigation services related to special education and the IDEIA; Knowledge and ability to serve as an Attorney-Advisor on highly complex legal issues, making substantive, programic, and administrative recommendations, and ability to make effective oral presentations in a clear and concise manner and demonstrated skill in preparing well-written, organized and persuasive legal documents.

The successful candidate must be a member of the District of Columbia Bar or eligible for waiver into the bar; also have excellent oral and written communication skills; and must have at least one year of experience in handling labor relations matters; the successful candidate must have a high level of technical legal knowledge of the full range of applicable DCPS, District of Columbia, and federal legal statues, codes and procedures in order to provide legal and quasi-legal services to the General Counsel, supervisor, DCPS administrative staff, and the Chancellor. The successful candidate must have a high level of familiarity with the Title 31 of the District of Columbia Code and DC Court Rules, Chapter 30 of the District of Columbia Municipal Regulations (DCMR), IDEIA, the Federal Educational Records and Privacy Act (FERPA), Section 504 of the Vocational Rehabilitation Act of 1973, the American’s With Disabilities Act of 1990 (ADA), the Elementary and Secondary Education Act of 1965(ESEA) (20 USC 6300 et. seq.), the No Child Left Behind Act of 2001, and the Freedom of Information Act.

Office of the State Superintendent of Education: Attorney-Advisor

The Office of the Attorney General of the District of Columbia is seeking a creative and energetic Attorney-Advisor to assist the Office of the General Counsel for the Office of the State Superintendent of Education (OSSE) with Special Education Reform at the state level, one of three critical action areas identified by the State Superintendent. The successful candidate for this position will have an exciting opportunity at a critical time to provide legal support to the OSSE’s Office of Special Education. The OSE is charged with creating and supporting interventions that allow students with disabilities to receive an excellent education and life-skills training to become well-educated, independent and productive members of the community. The successful candidate will work on policies and procedures supporting the new Special Education Data System (SEDS); the state complaint process; new guidance, policies and procedures regarding compliance by public charter schools; the newly established Due Process Complaint Student Hearing Office as well as reforms in the non-public tuition unit and the consolidation of Part C services for infants and toddlers with Part B services for older students. These functions, among others, were created as part of the OSSE’s new State Education Agency (SEA) responsibilities.

The Office of the State Superintendent of Education is responsible for setting high expectations, providing resources and support to local education agencies and exercising accountability to ensure that all District residents receive an excellent education for success in the 21st century. On June 12, 2007, the District of Columbia Public Education Reform Amendment Act of 2007 was signed into law, giving the OSSE authority over all SEA responsibilities formerly belonging to the District of Columbia Public Schools (DCPS), the University of the District of Columbia (UDC), and the Department of Human Services (DHS). As part of its new functions, the OSSE is responsible for representing the District of Columbia in all matters before the United States Department of Education, including the Office of Special Education and Rehabilitative Services. In addition, the OSSE is responsible for grant-making, oversight, and assuring that SEA functions for standards, assessments, and federal accountability requirements for elementary and secondary education. The successful candidate will advise the OSSE’s Office of Special Education as it administers, manages and monitors all federal special education grants and reforms local education funding for special education services.

The successful candidate will assist the General Counsel in providing legal and litigation support to ensure that students with special needs in the District of Columbia are served well. The successful candidate will provide support to the OSSE’s Office of Special Education and Due Process Complaint Student Hearing Office. In addition, the successful candidate will assist the OSSE in establishing updated rules, policies, procedures, and relevant forms to ensure compliance with the Individuals with Disabilities Education Improvement Act of 2004 (IDEA). The successful candidate will also be the point person for the OSSE on special education related class action lawsuits, including Blackman-Jones (timeliness of issuance of hearing officer decisions and implementation of hearing officer decisions) and Petties (timely payment of non-public tuition and provision of transportation services).

The successful candidate must have excellent oral and written communication skills, be accustomed to working in a fast-paced environment and possess a strong interest in education law and a desire to represent and effectuate positive change in the District of Columbia’s public education system and how it serves students with special needs. Knowledge in the Individuals with Disabilities Education Improvement Act of 2004 (IDEIA), and the District of Columbia Public Education Reform Act of 2007 is preferred as is the ability and experience to working with teams. Candidates who are highly motivated to become proficient in these areas will also be considered.


Personnel, Labor and Employment Division, Personnel and Labor Section: Trial Attorney

The District of Columbia Office of the Attorney General (OAG) seeks (one) trial attorney to join its Personnel and Labor Relations Section. The Personnel and Labor Relations Section defends agencies in personnel related matters such as suspensions, terminations for employee misconduct, and reductions-in-force before the Office of Employee Appeals, Police Adverse Action Panels and Trial Boards. The Section also represents agencies in disability compensation matters where benefits have been denied or terminated before the Office of Hearings and Adjudication of the Department of Employment Services.
